At the urging of hundreds of people like you across North Carolina, the NC Real Estate Commission agreed to require that all homebuyers be given complete information about a house’s flood risk before buying.

Subject North Carolinians need full flood risk disclosure

Dear Real Estate Commissioners:

I’m writing to you today because I continue to be very concerned about the insufficient amount of information related to flooding that property sellers must disclose when selling their home. Currently, North Carolina has one of the weakest flood disclosure policies in the country.

As a North Carolina resident, I’m glad that the Commission voted in February to require property sellers to disclose what they know about flood damages to homebuyers.

Now, the Commission must stand with homebuyers and officially adopt the proposed flood disclosure questions on the mandatory disclosure form. The additional questions would require property sellers to disclose past damages, information about the cost of flood insurance coverage, and information about flood risks. Property sellers do not currently have to disclose any of this information. Without that information, the home-buying process is plain unfair.

By providing this information to both buyers and sellers, buyers can make better-informed decisions about the home they choose to purchase and prevents surprises and unexpected financial burdens associated with flood damage. In this way, buyers can plan around these events by deciding whether to purchase flood insurance and other investments to address the risk of flooding.

Without that information, thousands of homebuyers in North Carolina may find themselves trapped in a home that floods repeatedly… all because the lack of transparency in real estate disclosures.

This past February, the North Carolina Real Estate Commission began the process of expanding flood disclosures in real estate transactions. I’m urging the Commission to take the final step and approve the new questions about flood risk and flood damages in the mandatory disclosure form.

With hurricane season now underway, it’s vital that you act quickly to strengthen flood disclosure policies. Please help ensure that homebuyers have information about past flooding and flood risks before they make a decision to purchase a home!
